Gavio pops up toaster-shaped speaker dock for iPhone

Phone just slides in and then drops down

Earlier this week, Singapore-based Gavio began offering iPod nano owners The Pill, an audio docking system in the shape of an over-sized medicine capsule. The company has now followed on with an intriguing appliance for iPhone owners, the Toast. The docking station is another sound system, this time taking the form-factor of a retro, drop-down bread toaster.

The Toast carries dual 50mm speakers powered by a three-watt amplifier. The frequency response is 150Hz to 18KHz, with a signal-to-noise ratio of 80dB. The system is powered by a 1,000mAh lithium-ion battery that lets it go completely wireless.

Gavio indicates the Toast is available for pre-order, but the company has provided no pricing or availability information. It's likely details will emerge from the company at CES next month.

Indonesian Mayor Refuses to Reinstate Church License

December 26, 2011

The refusal of the mayor of Bogor, Indonesia, to obey a Supreme Court order to restore a church's permit casts doubt on the ability of the Indonesian government to enforce the rule of law, according to Compass Direct News. Muslim demonstrators and area police have continually obstructed the services of the Indonesian Christian Church congregation in Bogor, which has been holding services on roadsides or in members' homes since the local government sealed its building last year. Despite a Dec. 2010 Supreme Court ruling in favor of the congregation and a July 2011 recommendation by the National Ombudsman Institute to reinstate the church's license, Bogor mayor Diani Budiarto still refuses, and local police are even reporting that the church building is going to be torn down. Civil rights groups say Budiarto's approach sets a precedent that court decisions can be ignored, and plan to file suit against Bogor over his defiance.

Feuding monks brawl at Church of the Nativity in Bethlehem

BETHLEHEM, West Bank ? The annual cleaning of one of Christianity's holiest churches deteriorated into a brawl between rival clergy Wednesday, as dozens of monks feuding over sacred space at the Church of the Nativity battled each other with brooms until police intervened.

The ancient church, built over the traditional site of Jesus' birth in Bethlehem, is shared by three Christian denominations ? Roman Catholics, Armenians and Greek Orthodox. Wednesday's fight erupted between Greek and Armenian clergy, with both sides accusing each other of encroaching on parts of the church to which they lay claim.

The monks were tidying up the church ahead of Orthodox Christmas celebrations in early January, following celebrations by Western Christians on Dec. 25. The fight erupted between monks along the border of their respective areas. Some shouted and hurled brooms.

Palestinian security forces rushed in to break up the melee, and no serious injuries were reported. A Palestinian police spokesman would not immediately comment.

A fragile status quo governs relations among the denominations at the ancient church, and to repair or clean a part of the structure is to own it, according to accepted practice. That means that letting other sects clean part of the church could allow one to gain ground at another's expense. Similar fights have taken place during the same late-December cleaning effort in the past.

Tensions between rival clergy at the church have been a fact of life there for centuries and have often been caught up in international politics.

In the 1800s, friction between the denominations at the church ? each backed by foreign powers ? became so fraught that Russian Czar Nicholas I deployed troops along the Danube to threaten a Turkish sultan who had been favoring the Catholics over the Orthodox.

Those disagreements threaten the integrity of the church itself, which was originally built 1,500 years ago and parts of which have fallen into disrepair. Although the roof has needed urgent work for decades, and leaking rainwater has ruined much of the priceless artwork inside, a renovation has been delayed all these years by disagreements among the denominations over who would pay.

Only recently, the Palestinian Authority brokered an agreement to move ahead with replacing the roof, and officials hope work will begin in 2012.

Minister: Spain to fall back into recession (AP)

MADRID ? Spain will slide back into recession early next year with the current quarter and the first of 2012 both registering negative growth, new Economy Minister Luis de Guindos said Monday.

De Guindos said he expects the economy ? the eurozone's fourth largest ? to contract by between 0.2 percent and 0.3 percent in the final three months of this year and again in the first quarter of next year. He said the outlook for next year was poor.

"Let nobody be fooled, the next two quarters are not going to be easy either in terms of growth or employment," de Guindos said.

Spain began to emerge from a near two-year recession last year. It had two successive quarters of growth in 2011 before posting zero growth in the third period.

De Guindos took office last week as part of the new conservative Popular Party government. He said then he was confident the country would emerge from its severe economic crisis and return to prosperity and its former status as a job creator.

Spain has the highest unemployment rate of the 17 countries that use the euro, with 21.5 percent joblessness, and is running a swollen budget deficit following the recession that started with the collapse of a real estate bubble.

The Popular Party won a landslide victory in Nov. 20 elections on a promise to get the economy moving again.

Prime Minister Mariano Rajoy has pledged austerity cuts totaling euro16.5 billion ($21.6 billion) and promised labor reforms.

His government is to begin approving urgent measures Friday, including a freeze on filling new civil service vacancies. except in key areas such as the security forces.

Spain has already made sharp cuts to its national spending and introduced several reforms under the former Socialist government, but the economy has failed to respond.

Navteq traffic to launch on Garmin devices using HD radio technology

The state of morning gridlock just got a little more real with the introduction of Navteq's real-time traffic via HD radio -- to be included with Garmin's nüvi 3490LMT personal navigation device. The service is said to be four to ten times faster than other similar offerings, updating details every 30 seconds for 270,000 miles of bumper-to-bumper goodness. Lucky for us, the feature will be available on other nüvi devices as well, using the Garmin GTM 60 adapter. Push past the break to check out the full PR.

Texas Department of Transportation shares repair report

Texas Department of Transportation reports there are seven projects under way in Grayson and Fannin counties. This is the current status of these projects between now and Sunday, Jan. 1. TxDOT reminds drivers to be cautious in these and all construction zones, and to be watching for flagmen, traffic cones and barriers, and other warning and directional information provided.

Grayson County

U.S. Highway 75, Sherman ?U.S. 75 south of FM 1417, R.K. Hall Construction is working on a ramp reversal project on the entrance ramp. The entrance from the frontage road to U.S. 75 is closed and the southbound frontage road is one lane. This project is expected to take until the end of March to complete.

U.S. Highway 69 (Austin Avenue), Denison ? Bridge replacement on the viaduct over the railroad tracks, which is actually two separate bridges joined together as one. Northbound traffic lane is moved onto the west bridge (originally the south traffic lane) and traffic in both directions is reduced to one lane across the bridge. Demolition has begun on the east bridge. The project is expected to take until March 31, 2013, to complete. L&N Bridge has been awarded the contract.

State Highway 91, Denison ? R.K. Hall Construction is continuing its work on an overpass at the Union Pacific Railroad crossing in the north Denison area. This is affecting both north- and south-bound traffic. Work will continue through October 2012.

Fannin County

State Highway 78 at Loop 205 ? The contractor, R.K. Hall Construction, is currently removing the existing pavement. Loop 205 lanes from SH 78 to Veterans Hospital will be closed, allowing local through-traffic only. Both north- and south-bound traffic will be affected in this project involving hot-mix overlay. The projected completion date is February 2013.

State Highway 121 ? Main lane work has been completed north of U.S. 69. The final 1.5 inches of surface is yet to be placed on the section south of U.S. 69. However, due to detrimental effects of low temperatures on hot-mix placement, this project is being suspected until warmer temperatures. Roadway will be striped and all lanes open during this time. Austin Bridge & Road has this contract. The estimated date for completion is being adjusted.

FM 273 ? TxDOT has contracted with D.L. Lennon Inc. to widen existing roadways. There could be delays and lane reductions. At night, all lanes of traffic should be open. This project will continue through May 2012.

Bridges being replaced ? TxDOT has contracted with Hodges & Son Construction to replace several bridges in Fannin County. Fannin County Road 3550 at Wafer Creek should be complete by Feb. 24. Future bridge replacements are planned at FCR 3935 at Pecan Creek tributary and FCR 1015 at Murphy Creek will be closed for the next three months, open only to through traffic. CR 3434 and CR 3433 are expected to be opened to through traffic in late January. While under construction, the roads at these bridges are not available to through traffic, but will remain accessible to local traffic.

?

AskTxDOT : TxDOT is accepting questions by e-mail, and as many of those questions as can be answered will appear in each published report. This will continue as long as the public sends questions. They need to be received by Wednesday of each week. The e-mail address established for this service is TxDOTParisDistrict@gmail.com.

Last week, the question was posed about directional signs on FM 1753. The reader stated: When traveling east on 1753 (Ambrose Road) you come to a sign that reads: Richerson Road then E. Texas St. Road. This should be reversed, the reader asked. And then said the same is true if traveling west on 1753, those signs need to be reversed. TxDOT Assistant Area Engineer Noel Paramananatham said he is working with the district (Paris) office to get those corrected.

Fuhu Nabi Kids Tablet

With tablets?finding their way into more and more households, there is a sensible need for a child-friendly solution. For most, giving your child free rein over an expensive device like the iPad 2?($499-$829, 4.5 stars) may not be the best idea. Not only are parents afraid of damage to their precious pads, but they should also be concerned about exposure to inappropriate content. That's where Fuhu's Nabi Kids Tablet ($199.99, sold exclusively at Toys R Us) steps in. The 7-inch? tablet features two distinct Android environments; one sheltered interface catering to kids and one nearly full featured, traditional Android interface. The Nabi is not a toy, but it is also not quite a tablet either. It packs a collection of pre-loaded apps and content, and a customizable child-safe interface, in a tablet that comes with a thick rubber bumper. But some problems with functionality and responsiveness hold the Nabi tablet back.??

Design and Display
The first thing you will notice about the Nabi is its striking red, oversized rubber bumper. This thing is really solid and looks like it could withstand most anything a child might throw at it (or throw it at). But the bumper isn't integrated into the tablet; it's just a peel-off gel case. It's too easily removable and doesn't make the tablet waterproof. It does offer solid drop protection, but it also makes the Power and Volume buttons difficult to press.

Under the rubber bumper is an unassuming white plastic slab. Together with the bumper, the Nabi measures 10.6 by 7.7 by 3.5 inches (HWD) and weighs 1.2 pounds; bigger and heavier than the Kindle Fire?($199, 4 stars) at 7.5 by 4.7 by .45 inches (HWD) and 14.6 ounces, but far better equipped for the rigors of playtime. The Nabi sports a 7-inch, 800-by-480-pixel TFT display, a low resolution you're more likely to find on a phone than a tablet. It's an upgrade over child-oriented tablets like the LeapFrog LeapPad Explorer's ($99, 4.5 stars) 480-by-272-pixel display, but not as nice as the 1,024-by-600 screens on high-quality 7-inch tablets like the the Kindle Fire or Nook Tablet?($249, 4 stars). The screen is bright, and viewing angles are pretty narrow. The biggest problem with the Nabi's display is unresponsiveness. In my tests, it often took multiple touches to get the desired response. This was while navigating through the tablet's interface, and playing games like Cut the Rope.

The tablet is equipped with a mini HDMI port, so you can connect it to an HDTV for playback, and a front-facing camera. For connectivity, there's 802.11b/g Wi-Fi and Bluetooth.

OS, Apps, Performance
The real draw of the Nabi Kids Tablet is the kids-only interface it lays on top of the now-obsolete Android 2.2. Kidz Mode is a child-safe, stripped-down environment that basically consists of oversized app icons, as well as shortcuts to Nabi's child-friendly Web and multimedia content. Any parent worried about what kind of trouble their kids can get into will appreciate the walled-off nature of Kidz Mode.

Parents can customize what apps appear in Kidz Mode, deciding for themselves what is or is not appropriate for their child. The tablet comes preloaded with games, educational apps, and childrens' books and videos. You get Angry Birds and Cut the Rope, 30 preloaded childrens' books with audio tracks for reading along, and Fooz Kids University, which is math training software for elementary schoolers. Kidz Mode also features a section of kid-safe Web shortcuts to third-party sites like Cartoon Network.

Though the browser supports Flash, which is used heavily in the third-party websites, the games and content didn't work very well on the Nabi in my tests. The sites were clearly meant to be enjoyed on a real computer, with little mobile, let alone tablet, optimization. For instance, one Cartoon Network link leads to a Flash-based game, which loads properly, but requires keyboard and mouse controls to work, which the Nabi lacks.

Ridley Scott's 'Prometheus' trailer recalls 'Alien'-style sci fi horror (Video)

A team of futuristic space explorers discover a mysterious (and dangerous) extraterrestrial world in the ominous teaser trailer for director Ridley Scott?s ?Prometheus?.

20th Century Fox has?really?been?milking fan interest in seeing the teaser trailer for Ridley Scott?s?Prometheus?this week, by releasing?multiple trailer previews?that offer brief glances at some actual footage from the film, but are by and large composed of short interviews with the esteemed filmmaker (Scott) talking about his third venture into the sci-fi genre - following in the footsteps of classic titles like?Alien?and?Blade Runner.

Skip to next paragraph Screen Rant

Screen Rant had a humble start back in 2003 as a place to rant about some of the dumber stuff related to the movie industry. Since then, the site has grown to cover more and more TV and movie news (and not just the dumb stuff) along with sometimes controversial movie reviews. The goal at Screen Rant is to cover stories and review movies from a middle ground/average person perspective.

Recent posts

Prometheus?looks to combine sci-fi and horror tropes in a fashion similar to that of?Alien; matter-of-fact, the new?Prometheus?teaser trailer plays out as a stylistic homage to the promo for Scott?s original 1979 film.

Here is an official description of?Prometheus:

Ridley Scott, director of ?Alien? and ?Blade Runner,? returns to the genre he helped define. With PROMETHEUS, he creates a groundbreaking mythology, in which a team of explorers discover a clue to the origins of mankind on Earth, leading them on a thrilling journey to the darkest corners of the universe. There, they must fight a terrifying battle to save the future of the human race.

Now check out the official?Prometheus?teaser trailer and compare it to the original?Alien?trailer (which we?ve also linked to below):

Prometheus Trailer:

Original Alien trailer:

Between the eerie audial background, quick cuts of disturbingly violent imagery, visuals depicting mysterious events, and astronauts exploring an evocatively dark and uninviting extraterrestrial world, the trailer for?Prometheus?evokes the intriguingly unnerving atmosphere of the iconic?Alien?theatrical preview. Likewise, the former title also aims to be a similarly moody and psychologically taut tale that chronicles a collection of humans? (and one android?s) descent into madness, upon encountering less-than-friendly other-worldly lifeforms.

Scott has emphasized many a time that?Prometheus?confronts some pretty?troubling philosophical ideas and concepts, concerning not only the nature of humanity?s evolution, but also its eventual destination, as a species. Between those thematic elements and the gorgeously shadowy and practical production design (which should actually look?better?on the big screen in 3D) there?s really good reason for fans of cerebral sci-fi to get excited about seeing this flick.

Prometheus?will be released in theaters (2D and 3D) around the U.S. on June 8th, 2012.

Most entrepreneurs aren?t born liars, but we?re brought up in a system that rewards bad behavior and taking the easy way out by lying instead of being truthful, something that eventually catches up with you. PlayStation Vita enjoys great first week. Is it enough?

The PlayStation Vita, the newest handheld from Sony, is due on shelves in the States in 2012. In Japan, the Vita is already off and running. ?

The PlayStation Vita ? competitor to the Nintendo 3DS, and successor to the Sony PSP ? isn't slated to hit shelves in the US until February. But in Japan, the Vita has already launched, and according to the analytics firm Enterbrain, the device is off to a strong start.?In a press release this week, Enterbrain estimated that?Sony had unloaded 321,000 Vita units in two days, just shy of the 371,000 3DS units sold by Nintendo over the same time period.?

The Vita, more so than the 3DS, is a graphical powerhouse, intended to appeal to committed gamers. As?Sony exec?Shuhei Yoshida?told?Eurogamer earlier this year, "if you are a very casual person who might just want to kill time as you're waiting for your train, you might not need a dedicated, big game experience. But if you like games, if you really love games, you would want to play the kind of games you like, even on the portable."?

Among the niceties on the Vita are a 5-inch OLED touch screen, a?4-core?ARM Cortex-A9 MPCore?processor, the?Sixaxis?motion sensing system and a?three-axis electronic compass. In the US, the Vita will sell at two price points:?$250 for a Wi-Fi-only version or $300 for a 3G version. In an early hands-on with the device, the CNET team called the Vita "dazzling."?

The question, of course, is whether even a "dazzling" gaming portable will be able to grab lasting market traction in 2012. Many users increasingly prefer to play portable games on their tablets or smart phones, calling into question the very concept of a committed gaming device (to say nothing of a committed gaming device that costs 300 bucks with 3G monthly payments).?

Consider the Nintendo 3DS, which?debuted in the?US?in late March to?generally favorable reviews.?By June, however Nintendo had managed to unload only 710,000 3DS units ? far short of expectations ? and in late July, in an effort to work up some excitement in the device, Nintendo dropped the price on its?3DS?from $249 to $169. It was, one pundit?quipped, the "fastest post-launch price drop (by one-third) ever."

Sales are reportedly up ? Nintendo execs have promised the 3DS has "good momentum" going into the holidays ? but thus far, the 3DS has fallen far short of the DS, the insanely popular handheld launched by Nintendo in 2004.?

dotCommonweal ? Blog Archive ? Contraception, health-insurance ...

Contraception, health-insurance reform & religious freedom

December 20, 2011, 4:33 pm

From the editorial, ?An Illiberal Mandate,? just posted on the homepage:

In August, the Department of Health and Human Services issued a ?draft? ruling that would mandate coverage of contraception and sterilization in health-insurance plans, including those provided to employees of Catholic institutions. The ruling offers an exemption from the mandate only to religious institutions that primarily employ and serve coreligionists, and whose work is strictly religious. As HHS sees it, access to contraception is a fundamental component of any health-care plan, especially for women. That claim seems commonsensical to many people, including many Catholics. The USCCB argues that compelling the church to pay for plans that cover services the church has long held to be immoral violates the religious-freedom guarantee of the First Amendment. Catholic hospitals, universities, and social-service agencies see their mission as caring for people of all faiths or none, and they employ many non-Catholics. Given this understanding of mission, inevitably there will be a degree of entanglement between any large religious institution and the modern state. That should not be an excuse, however, for imposing secular values on more traditional religious communities. Religious diversity is impossible without a degree of autonomy from the state. Is there any evidence that such autonomy poses a serious threat to liberal democracy??

[E]xcept when life or limb is at stake, it is hard to see what is ?liberal? in coercing religious individuals and institutions. There are other ways that contraception can be made available to employees of Catholic institutions, should they choose to use it. One does not need to oppose contraception to see that, in this case, it?s far less important than the principle, and practice, of religious freedom.

PFT: Rams probably to shut Bradford down

AP-Top-scientists-endorse-HGH-test-R1FI8TC-x-largeGetty Images

The effort by Congress to compel the NFL and the NFLPA to follow through on their agreement to conduct HGH testing has petered out in recent weeks.? At a time when both sides have reason to be concerned about Congress opting to move aggressively regarding the inability of the parties to turn their agreement to conduct HGH testing into actual HGH testing, the latest effort from Capitol Hill looks more like window dressing than meaningful action.

Earlier this week, four doctors who serve in the U.S. House of Representatives sent a letter to NFL Commissioner Roger Goodell and NFLPA executive director DeMaurice Smith urging the adoption of HGH testing.? The letter, signed by Dr. David ?Phil? Roe (R-Tenn.), Dr. John Fleming (R-La.), Dr. Phil Gingrey (R-Ga.), Dr. Donna Christensen (D-Virgin Islands), points out the risks and side effects of HGH (cancer, diabetes, hypertenson, harm to reproductive health, thyroid problems, and abnormal growth of bone and connective tissue).? The doctors also explain that HGH is normally prescribed only for patients in the late stages of AIDS, for children with growth hormone deficiency, and for treatment of certain types of pituitary tumors.

And then there?s the fact that HGH possession and use without a prescription is illegal.

But there?s no teeth to the letter or any of the other efforts to date from Congress.? The Committee on Oversight and Government Reform reportedly intends at some point to conduct public hearings and/or private efforts to gather information that could result in players being placed under oath about what they know about HGH us and how they or others get HGH, absent clear progress toward HGH testing.? As the offseason approaches, however, the likelihood of the NFL and the union working together to resolve the situation will increase.? Some believe that NFLPA executive director DeMaurice Smith has been trying to delay the issue until after his re-election in March 2012, given that a significant number of players are opposed to HGH testing of any kind.

Regardless, the new CBA clearly states that HGH testing will occur.? The only question is how it will happen.? To date, the NFLPA has refused to proceed with the procedure used by the World Anti-Doping Agency.? (Though the NFLPA has not suggested a test other than the WADA procedure, the NFLPA last month suggested a protocol premised on the WADA test.)? Congress has accused the NFLPA of dragging its feet, but the NFL likewise has failed to enforce the agreement via any of the available legal remedies for forcing a party to honor its written commitments.

Thus, the blame on this one cuts both ways.? The NFLPA has failed to honor its agreement, and the NFL has opted to merely sit back and wait for someone else to pressure the NFLPA to live up to its word.? If the NFL were genuinely serious about eradicating HGH from the game, the NFL would have pursued arbitration and/or litigation aimed at forcing the issue.

And if Congress were genuinely serious about it, they would be doing more than sending letters.

Michael Jackson house contents sell for nearly $1M

BEVERLY HILLS, Calif. (AP) ? The contents of the home where Michael Jackson lived with his three children just before his death have sold for nearly $1 million at auction.

Darren Julien, president of Julien's Auctions, was unable to provide a more specific figure as he continued to tally the totals Saturday after the daylong auction, which brought in nearly triple the company's pre-auction estimate of $200,000 to $400,000.

Among the highlights: A kitchen chalkboard where Jackson's children wrote "I love daddy," which sold for $5,000, and an armoire upon which Jackson wrote a message to himself on the mirror that fetched $25,750.

The auction also included furniture, artwork and other items from the rented mansion at 100 North Carolwood Drive, where Jackson lived as he prepared for a series of comeback concerts in London before his death in June, 2009.

The headboard from the bed where Jackson died at age 50 was removed from the auction at the family's request, but the rug that was beneath the bed sold for $15,360. The estimate had been $400 to $600.

Julien's Auctions re-created the mansion inside its Beverly Hills showroom and invited fans to fill the space where the bed would have been with a tribute to the late King of Pop. Julien promised to deliver all of the tribute items to Jackson's children and family matriarch Katherine Jackson.

"Michael Jackson has the greatest fans in the world. I can see why he lived for them," Julien said. "They came out every day this week to bring gifts. It's unlike anything we've ever seen as it relates to a celebrity and their fans."

Julien's Auctions has conducted auctions for dozens of celebrities, including Cher, Barbra Streisand, William Shatner and Slash.

Jackson commissioned the company to sell the contents of his Neverland Ranch before the auction was called off in early 2009. Julien's also sold Jackson's famous "Thriller" jacket for $1.8 million earlier this year.

Australian music legend fights for life after fall (Reuters)

SYDNEY, Dec 16 (RTRS) ? Ian Meldrum, Australia's top music journalist and a friend of singer Elton John is in critical condition after falling from a ladder while hanging Christmas decorations, doctors said on Friday.

Meldrum, who was given the nickname "Molly" early in his career by a DJ who had the habit of dishing out female names, fell at his Melbourne home and struck his head on some tiles on Sunday. His gardener found him unconscious and not breathing.

His injuries include a fractured skull and punctured lung as well as a number of broken ribs.

"This is a life and death matter," said Jeffrey Rosenfeld, a neurosurgeon and professor told journalists outside Melbourne's The Alfred hospital.

Sometimes called the single most important person in the Australian pop music industry, Meldrum's career of more than four decades has seen him interview most music celebrities passing through Australia, as well as luminaries such as Britain's Prince Charles.

He most recently interviewed Beyonce and was a personal friend of Kylie Minogue, who joined a flood of well-wishers on social media sites to send a message of concern.

"Sending lots of love to Molly Meldrum, I love you," she tweeted.

Olympus fixes crooked accounts; takeover talk (Reuters)

TOKYO (Reuters) ? Japan's disgraced Olympus Corp ironed out its crooked accounts on Wednesday, unwinding a 13-year fraud to reveal a $655 million dent in its balance sheet and igniting speculation it would need to merge or sell assets to repair its finances.

The maker of cameras and medical equipment filed five years' worth of corrected statements, plus its overdue first-half results, just hours before a deadline set by the Tokyo Stock Exchange, which would have delisted the firm if it had failed.

The most recent restatement, for end-March 2011, showed a 51 billion yen ($655 million) reduction in Olympus' net assets, and Olympus added that at of end-September, net assets stood at just 46 billion yen, down from a restated 225 billion in March 2007.

It also revealed a net loss of 32.33 billion yen for the six months ended September 30, further fuelling talk that the once-venerable firm would need to take quick steps to shore up its balance sheet or risk becoming prey to a takeover.

"Most probably Olympus has to increase capital. It's best for the company to merge with others rather than rebuild by itself," said Ryosuke Okazaki, chief investment officer at ITC Investment Partners.

Olympus has been dogged by rumors of bid interest from rivals, such as fellow endoscope makers Fujifilm and Hoya, or from private equity since it sacked its British chief executive and the scandal broke in October.

The stock, which has lost about half its value to about $4.7 billion since then, finished the day down 4 percent.

RELIEVED, BUT NOT OUT OF THE WOODS

Some investors were at least relieved on Wednesday that Olympus had met the deadline for fix its accounts, without having slid into technical insolvency at any stage. Olympus also assured investors that it was able to secure continued funding.

"This is extremely positive for Olympus as it can avoid getting delisted after meeting the deadline to submit its earnings," Okazaki said.

Other investors, though, remained wary, noting that the exchange could still delist Olympus if it deemed the past misrepresentations of its financial health were large enough.

"Although liabilities had not exceeded assets, it does not change the fact that they were window-dressing and since the amount involved is so big and the period of time this was going on was so long, it is difficult to say what the Tokyo Stock Exchange will do," said Fujio Ando, senior managing director at Chibagin Asset Management.

"I would not say that fear of delisting has disappeared because they filed their revised earnings."

The Tokyo exchange said after the announcements that it was keeping Olympus in its watchlist for possible delisting.

Some of the restated accounts also came with qualified opinions from auditors, with KPMG AZSA LLC noting that it had been unable to confirm all the money flows involved in the fraud. "We were unable to get sufficient and appropriate proofs for auditing on specific assets and amounts," the auditor wrote.

BOARDROOM BATTLE LOOMS

Olympus triggered the crisis on October 14 when it sacked its British CEO, Michael Woodford, who immediately blew the whistle on the firm's accounting problems. Woodford is now waging a campaign to be reinstated, appealing to shareholders to support his comeback as part of a complete renewal of the board.

The board has committed to resigning over the scandal, but wants to choose its own successors before quitting, setting up the prospect of a proxy war between its own candidates and those being assembled by Woodford as part of his campaign.

"The shareholding balance is such that there is a realistic chance we could win a proxy fight," Woodford said. But he added that such a battle would cause a split between foreign and Japanese shareholders and that he hoped it could be avoided.

Some big foreign shareholders back Woodford's bid but Japanese institutional investors, although reticent, appear worried about whether he can win over the company's employees as well as his plans to turn around the once-proud firm.

"I think it would be harmful because it would show potentially Japan institutional investors are a club," Woodford said about a possible proxy battle.

He said he was willing to meet Olympus President Shuichi Takayama at any time but added incumbent directors were too discredited to be in a position to choose their successors.

Woodford, who was a rare foreign CEO in Japan, also sought to soothe concerns about his plans to restore trust in Olympus.

"I want no part in selling Olympus or breaking it up," he said, adding he would not close down the firm's struggling camera business.

"People say the 'gaijin' president would shut it," Woodford said, using the Japanese word for foreigner. "I wouldn't."

ACLU says 4 US citizens in California arrested through federal immigration enforcement program

LOS ANGELES - Four U.S. citizens were erroneously arrested in Southern California recently through the federal immigration enforcement program called Secure Communities, the American Civil Liberties Union said Wednesday.

The arrests offer another point of tension between immigrant rights groups and Homeland Security, especially after President Barack Obama's administration said the highly criticized local-federal immigration enforcement program would only focus on illegal immigrants with serious criminal records.

Secure Communities, administered by U.S Immigration and Customs Enforcement, allows fingerprint analysis to identify illegal immigrants in county jails.

Immigrant right groups say Secure Communities can discourage immigrants from reporting crimes and can lead to the deportation of people who haven't been convicted of anything.

"We demand that the county and the city of Los Angeles stop collaborating with (ICE) and that the Obama Administration stop Secure Communities once and for all," said Marielena Hincapie, executive director of the National Immigration Law Center.

According to the ACLU, three Hispanic men were arrested and put on immigration holds after being processed through Secure Communities in November, and a fourth one went through the same process in July.

One of the men, Antonio Montejano, said he was arrested Nov. 5 in Santa Monica and spent four days in jail after he forgot to pay for candy his kids ate while shopping at a local Sears store.

He was also arrested because a $10 bottle of perfume was not scanned, even though he bought $600 worth of merchandise, the ACLU said.

A Los Angeles County judge ordered Montejano's release, but he was kept jailed because of an immigration hold, the ACLU said.

In jail, no one believed he was a citizen, Montejano recounted, because he speaks with an accent. He said he has split his time between Mexico and the U.S.

He was released after the ACLU sent ICE Montejano's passport and birth certificate.

ICE spokeswoman Gillian Christensen said the cases cited by the ACLU are "highly unusual with unique factual circumstances."

"Secure Communities is not designed and should not be used to detain U.S. citizens, and we work hand-in-hand with our state and local partners to ensure that it is used appropriately," she added.

Under Secure Communities, arrestee fingerprint information is checked against FBI criminal history records and biometrics-based immigration records kept by Homeland Security. If an irregularity is found, a "hold" is placed on a person, usually leading to deportation.

Montejano, and another citizen detained, Jose Velazquez, said they planned to sue for their incarceration.

In October, a study by the Chief Justice Earl Warren Institute on Law & Social Policy at the University of California, Berkeley, found that ICE arrested more than 3,600 U.S. citizens through Secure Communities between April 2008 and April 2011.

Syria says "would like" to accept Arab deal (Reuters)

BEIRUT (Reuters) ? Syria said on Monday it "would like" to agree soon to an Arab League peace plan to end its eight-month crackdown on popular unrest, but rejected foreign interference and demanded the annulment of sanctions plus reinstatement in the regional bloc.

The conditions were set in a letter to the League by Foreign Minister Walid al-Mualem, described by his spokesman as a "positive" response requiring an Arab League reply.

In Cairo, Arab League secretary general Nabil Elaraby said "the conditions contained new elements that we have not heard before." Arab foreign league ministers were studying the response.

Syria meanwhile has retaliated against northern neighbor Turkey for the sanctions imposed by its former friend, imposing a tariff of 30 percent on its imports and prohibitive duties on fuel and freight.

Turkey shrugged it off, saying "common sense" should tell Syria that its own people would suffer most.

In a display of muscle that could be intended to deter any idea of foreign military intervention in a crisis which has killed at least 4,000 people, the army staged a big exercise with missiles, rockets, tanks and helicopters.

Top generals watched the war games and state television made it the headline news story, even as the death toll mounted.

Five civilians were killed by security forces in Homs, the country's third largest city, according to the activist website Syrian Observatory for Human Rights. Four died when troops fired on a funeral procession and

One man was shot at a hospital. A youth died of gunshot wounds sustained at the weekend.

In southern Deraa province, three members of the security forces were shot dead by army defectors in front of the Dael courthouse, the website said. The corpse of Ismail Aqla al-Amri, 35, was handed to back relatives in Deraa, a victim of state torture, it said, and dozens more arrests were reported.

SANCTIONS

Already hit by economic sanctions imposed by the United States and Europe, Syria was punished last month by neighboring states, with sanctions announced by the Arab League and imposed by Turkey, once President Bashar al-Assad's ally.

The Arab League's sanctions have yet to take effect. It has repeatedly extended deadlines for Damascus to agree to a peace plan that would see Arab monitors oversee its withdrawal of troops from towns. The latest expired on Sunday.

Foreign ministry spokesman Jihad Makdesi said Damascus was still looking at the Arab League plan.

"The protocol is intended to be signed soon," he said. "The Syrian government has responded positively ...I am optimistic, although I await the Arab League response first."

Syria says the Arab proposal to admit observers infringes its sovereignty, and has asked for clarification. It has stalled more than once and reneged on promises to rein in its forces.

SANA expressed regret mixed with defiance of sanctions.

"The Arab League sanctions ... have been a shock for every Syrian and Arab citizen ... as these sanctions came from sisterly countries," it said. "Syria will overcome those sanctions by virtue of its strategic location and the diversity of its production sectors," the state agency added.

Syria's Arab neighbors Iraq, Lebanon and Jordan have all said they would not join a trade sanctions campaign.

ROCKETS

In a reminder to outsiders of Syria's powerful, mainly Russian-supplied armed forces, state television and SANA showed top generals watching a live-fire exercise by missile units, mechanized brigades and aircraft, to test their capacity in "confronting any attack" on Syria.

It did not report the scale of the war games.

"General (Dawood Abdullah) Rajiha stressed that the armed forces, under the leadership of President Bashar al-Assad will remain loyal to the homeland and will defend the interests of the Syrian people," SANA said. Rajiha is Minister of Defence.

Makdesi, the foreign ministry spokesman, said the war games were a "routine" exercise and not intended to send any message.

The first cracks appeared in one of the pillars of Assad's regime at the weekend with the desertion of some members of the secret police to the ranks of a rebel "free army."

At least a dozen members of the secret police deserted from the Airforce Intelligence complex in Idlib city, 280 km (175 miles) northwest of Damascus, triggering a gunbattle with defectors in which 10 were killed or wounded on either side, activists said.

Opposition sources said a further 16 soldiers defected from units in Idlib on Sunday and a new group of defectors of similar size battled loyalist troops to the south, in the Josieh area on the border with Lebanon.

Assad's opponents estimate the strength of the rebel force at several thousand, mainly army recruits from Syria's Sunni Muslim majority. Members of Assad's minority Alawite sect, an offshoot of Shi'ite Islam, have a tight grip on the military and security apparatus.

SANA on Monday reported military funerals "with flowers and wreaths" for a further seven killed.
